WAIVER AND RELEASE FORM

I hereby agree to and make the following contractual representations pursuant to this Waiver and Release of Liability. I hereby affirm that I am in good health and in proper physical condition to participate in the activities organized by M/S Transcend Adventures. I understand that participation in these adventure activities may involve certain inherent risks. These risks may include, but are not limited to, the potential for minor or serious injuries, illness, damage to property or equipment, or unforeseen situations beyond the control of the organizers. These risks may result from my own actions or inactions, those of other participants, or factors related to the natural environment. I acknowledge and accept personal responsibility for any risks associated with my participation. I agree to be familiar with and to abide by all rules and regulations established for the Activities in which I participate. I also accept sole responsibility for my own conduct and actions while participating in these Activities. I hereby release, waiver, and covenant not to sue, and further agree to indemnify and hold harmless M/S Transcend Adventures, together with the organizers, promoters, sponsors, advertisers, hosts, venue and property owners upon which the Activities take place, law enforcement agencies and other public entities providing support for the Activities, and each of their respective parent, subsidiary and affiliated companies, officers, directors, partners, shareholders, members, agents, employees and volunteers, with respect to any liability, claim(s), demand(s), cause(s) of action, damage(s), loss or expense. I hereby warrant that I have read this Agreement carefully, understand its terms and conditions, and I acknowledge that I have signed this Agreement freely and voluntarily, without any inducement, assurance, or guarantee, and intend for my signature to serve as confirmation of my complete and unconditional acceptance of the terms, conditions and provisions of this Agreement. This Agreement represents the complete understanding between the parties regarding these issues and no oral representation, statements, or inducements have been made apart from this Agreement.

IF PERSON IS UNDER 18 YEARS OF AGE, A PARENT OR LEGAL GUARDIAN MUST SUBMIT THE FORM, THEREBY AGREEING TO:
I, the parent or legal guardian of the minor hereby execute the foregoing Waiver and Release for and on behalf of Minor and agree to bind myself, Minor and any heirs, next of kin, assigns or personal representatives to the terms of this Waiver and Release.
